CONDANNA DI GOTOVINA E MARKAC: LA DICHIARAZIONE DEL PRESIDENTE CROATO

Qui di seguito riporto la dichiarazione del presidente croato Ivo Josipović a seguito della condanna dei generali Ante Gotovina e Mladen Markač emessa dal Tribunale internazionale per l'ex Jugoslavia, come pubblicata sul sito ufficiale dell'ufficio del presidente.


STATEMENT FOR THE MEDIA BY THE PRESIDENT OF THE REPUBLIC OF CROATIA, PROF. DR. IVO JOSIPOVIĆ, FOLLOWING THE CONVICTION (SUBJECT TO APPEAL) OF GENERALS GOTOVINA AND MARKAČ
 
The conviction of Generals Gotovina and Markač including the reasons for judgment and sentence, in particular the thesis on the existence of a joint criminal enterprise involving Croatia’s highest political and military leadership, is a serious legal and political act which has shocked me also.
 
These generals who gave a great contribution to Croatia’s defence during the war have been convicted by the International Criminal Tribunal for grave crimes. Many citizens find it difficult to accept the judgement and are disappointed with the decision of the Tribunal.
 
The judgement, however grave it may be, does not call into question the legitimacy and legality of the Croatian War of Independence nor the legitimacy and legality of its liberating operations, including Operation Storm. Something of the sort is neither possible, nor would we in Croatia accept it. I am convinced that there was no joint criminal enterprise during Croatia’s defence. To be specific, the thesis on the joint criminal enterprise does not imply that all members of the Croatian Army and police were participants of this criminal enterprise or that all are criminals. Croatia respects and will respect all the heroes who preserved our independence and freedom. In Croatia we are aware that during the Croatian War of Independence crimes were committed by all sides, including our own. Today, the Croatian justice system equally treats and convicts all crimes and shows respect for all victims, regardless of who the perpetrator or victim is. This is part of our legal order and our citizens and our general public sympathize with all innocent victims and their families.
 
Croatia is a state that respects the international legal order and the rule of law. I am confident that both the defenders of this country and all our citizens support such a Croatia. This is a European Croatia. We expect many of the theses underlying this judgement to be thoroughly reviewed and challenged during the appeal procedure. In particular, the respect for the legal aspects of the Tribunal’s work does not mean acceptance of the political and historical aspects of the judgement. For us, the Croatian War of Independence will, independently of this judgement, remain a just and defensive war in which we preserved our freedom and democracy from the aggression and the criminal policy of Slobodan Milošević's regime.
